“Do I need a tickbox for GDPR?” is one of the most common questions we get asked in our Membership – Your GDPR Advisor.

Unfortunately, it is not a simple yes or no answer.

It very much depends on what you think you need a tickbox for. The purpose of a tickbox is so that you can get consent for something, but a tickbox isn’t always necessary.

For example, a newsletter subscription form does not need a tickbox as by entering their name and email address and pressing submit they are agreeing to get the newsletter. Assuming you are clear that they are signing up for the newsletter, then no additional tickbox is required.

Another factor that will have an impact on whether you need a tickbox or not is whether you are Business to Business or Business to Consumer, as the rules for marketing including the provision of email newsletters is different for those two groups.

There is also whether you need an opt in or an opt out tick box and that assumes that the software you are using can manage tickboxes and segment the responses. Sometimes there needs to be a different work around because the software is poorly configured.

And finally if someone is already a customer and had bought from you, then the rules can be slightly different provided you are not a charity.

Now you can see why it’s not a simple yes or no answer and why so many members of Your GDPR Advisors ask the question, because there differing circumstances and what they are trying to do varies. At least they can get a prompt answer and move on.
